Please read the following important Terms of Service Agreement (the "Agreement") before accessing or using any of the various services (the "Services") made available to you (the "Member") by Caribsocial, Inc. ("Caribsocial ") through http://www.caribsocial.net  Caribsocial mobile applications or otherwise. ONLY USERS WHO ARE 16 YEARS OF AGE OR OLDER MAY REGISTER FOR CARIBSOCIAL. By completing the registration process for the Caribsocial website you represent that you are 16 years of age or older and can and will be legally bound by this Agreement. If you are under 16 years of age your parent or guardian must read and accept the terms of this Agreement - on your behalf - before you register. No Member may participate where doing so would be prohibited by any applicable law or regulation. 

Description of Services 
As a Member you are provided with a variety of Services as described on the Caribsocial (Products and Services) webpages. Members may also use certain additional services offered from time to time such as shopping - e-commerce offerings and various informational services.
Caribsocial reserves the right to enhance – modify - or discontinue the Services in whole or in part - at any time - for any reason or no reason at all at Caribsocial discretion with or without notice to Members, and with no obligation to Members.

Member Conduct 

Use of the Services by you, as Member, is subject to all applicable local, state, national and international laws and regulations. Caribsocial reserves the right but does not assume any obligation, to monitor the Services to enforce this Agreement. The responsibility of proper Service use within stated parameters falls to you the Member. Caribsocial offers no guarantee that any monitoring it does perform will be to the Member's satisfaction.

Upon learning of any violation of this Agreement, Caribsocial, at its sole discretion, may terminate your access to and use of the Services - require you to remedy such violation and or take any other actions that Caribsocial deems appropriate to ensure its rights and pursue all available remedies. Without limitation, Caribsocial reserves the right to terminate your access to and use of the Services if - in our view - your conduct fails to meet any of the following guidelines: 

Safety 

We do our best to keep Caribsocial safe. We need your help to keep Caribsocial safe, which includes the following commitments by you: 
You must not post unauthorized commercial communications (such as spam) on Caribsocial. 
You must not collect users' content or information or otherwise access Caribsocial using automated means (such as harvesting bots – robots – spiders - scrapers) without our prior permission. 
You will not engage in unlawful multi-level marketing such as pyramid schemes on Caribsocial. 
You must not upload viruses or other malicious codes.
You must not solicit login information or access an account belonging to someone else. 
You must not bully – intimidate - harass any user. 
You must not post content that is or can be considered hate speech – threatening – pornographic – to incite violence – to contain nudity - graphic gratuitous violence nor any content encouraging such responses by other users. 
You must not develop or operate a third-party application containing alcohol-related – dating - other mature content (including advertisements) without appropriate age-based restrictions. 
You must not use Caribsocial to do anything unlawful - misleading - malicious or discriminatory. 
You must not do anything that could disable – overburden - impair the proper working or appearance of Caribsocial such as a denial of service attack or interference with page rendering or other Service functionality. 
You will not facilitate or encourage any violations of this Statement or our policies. 

Registration and Account Security 

Caribsocial users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account: 
You must not provide any false personal information on Caribsocial, or create an account for anyone other than yourself without permission.
Should we disable your account, you will not create another one without our permission. 
You must not use Caribsocial if you are under 16. 
You must not use Caribsocial if you are a convicted sex offender. 
You must keep your contact information accurate and up-to-date. 
You must not share your password (or in the case of developers, your secret key), let anyone else access your account, or do anything else that might jeopardize the security of your account. 
You must not transfer your account (including any Page or Application you administer) to anyone without first getting our written permission. 
Should you select a username or similar identifier for your Account or Page we reserve the right to remove or reclaim it if we believe it is appropriate in such case as when a trademark owner complains about a username not closely related to a user's actual name. 

Protecting Other Members` Rights 

We respect other people's rights and expect you to do the same. 
You must not post content or take any action on Caribsocial that infringes or violates someone else's rights or otherwise violates the law. 
We have the full right to remove any content or information you post on Caribsocial if we believe that it violates our policies. 
We provide you with tools to help you protect your intellectual property rights.
If we remove your content for infringing someone else's copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal. 
If you repeatedly infringe on other people's intellectual property rights, we will disable your account when appropriate. 
You will not use our Copyrights or Trademarks or any similar marks except as expressly permitted by our Brand Usage Guidelines or with our prior written permission. 
Should you collect information from users you will: obtain their consent - make it clear you (and not Caribsocial) are the one collecting their information and post a privacy policy explaining what information you collect and how you will use it. 
You will not post anyone's identification documents or sensitive financial information on Caribsocial. 
You will not tag users or send email invitations to non-users without their consent. Caribsocial offers social reporting tools to enable users to provide Caribsocial with tagging.

 Agreement

The Agreement makes up the entire pact between the Member and Caribsocial and governs your use of the Services, superseding any prior agreements between the Member and Caribsocial.
You also may be subject to additional terms and conditions that may apply when you use affiliate services – third party content – third party software. The failure of the Company to exercise or enforce any right or provision of the Agreement shall not result in a waiver of such right or provision. The section titles in the Agreement are for convenience only and have no legal or contractual effect. In the event there is a discrepancy between this English language version and any translated copies of the Agreement the English version shall prevail. The side summaries within this Agreement are for reference only. If there is a discrepancy between the full terms of this Agreement and the language contained within the side summaries the full version of the Agreement shall prevail.
